Selling Bootlegs Now Legal

A US federal judge has ruled that it is perfectly legal to make a business of selling bootleg recordings. The decision “stands in marked contrast to existing law and prior decisions that have determined that Congress was well within its constitutional authority to adopt legislation that prevented trafficking in copies of unauthorized recordings of live performances,” said Jonathan Lamy, a spokesman for the RIAA.     This is amazing. I’m in the process of writing a Law Review article on this very topic. Sounds like the District Court Judge was on the right track. The anti-bootlegging statutes are horribly drafted and serve no compelling interest.
